Preamble
LauguiConcept, whose head office is located at 47 bis rue Benoît Malon, 76300 Sotteville lès Rouen – France, is organizing an online game (hereinafter referred to as the “Game” or the “Game Contest”).
The contests organized on the LauguiConcept Facebook® page are free and without obligation to purchase.
By taking part in the various contests via the Facebook® page of the LauguiConcept company, participants will be able to access the draw allowing one of them to win a prize, the nature of which is indicated in each publication. contest concerned. The games are accessible on LauguiConcept’s Facebook® gaming platform at the following address: https://www.facebook.com/LauguiConcept.
It is specified that the Contest Game is developed and managed by LauguiConcept to the exclusion of any sponsorship or intervention by the Facebook® company, only ensuring the hosting of the Contest Game within its Platform.
This document is the rules of the Contest, hereinafter referred to as the “Rules”. It may be supplemented and/or modified at any time during the duration of the Game, by any additional clause which will come into force by the mere fact of its publication online by LauguiConcept.
Any person is deemed to have read, understood and accepted, without reservation, the Rules in their entirety, and in particular the article relating to personal data as soon as they access and register for the Game.
All of the aforementioned documents are made available and accessible to any user and participant for the duration of the Game. The latter are asked to make a backup copy and/or print all of the aforementioned texts in order to be able to refer to them, if necessary.
Article 1: Conditions of access
1.1.
Participation in the Contest is open to anyone meeting the cumulative conditions below:
(i) natural and adult person,
(ii) having internet access and a valid personal email address,
(iii) having a Facebook® account and accessing the Contest via LauguiConcept’s Facebook® gaming platform for the duration indicated in the game publication concerned, at the following address: https://www.facebook .com/lauguiconcept.
LauguiConcept will, within the limits of the means at its disposal, verify compliance with these criteria. In the event that one of these criteria is not met, registration for the Contest Game cannot be validated.
1.2.
Participation in the Contest Game is limited to registration for the draw as detailed in article 2 below.
1.3.
Access to the Contest Game is prohibited for LauguiConcept employees and any natural or legal person who has collaborated or is collaborating in the organization of the Contest Game, including members of their close families (e.g. spouse, partner, child, sister and brother, parent, PACS partner).
Article 2: Participation
2.1.
The Contest Game is open to anyone who meets all the conditions mentioned in article 1.1 above, excluding anyone mentioned in article 1.3.
To register for the draw and try to win the prizes at stake in article 3.1, all participants must have carried out the actions mentioned below:

• Go to one of the dedicated publications
• Follow the detailed participation instructions in the dedicated publication
• Read, understand and unreservedly accept the Game Rules available via this “Competition Game” page.
Registration for the draw is effective only at the end of these steps.
It is understood that each participant undertakes to reveal correct information concerning him. LauguiConcept disclaims all liability in the event that a participant uses false names and/or first names associated with a valid e-mail address, or even usurps the identity of a third party.
2.2.
Participation in the Contest Game is carried out exclusively electronically on LauguiConcept’s Facebook® game platform in an exclusive manner, the draw being carried out among the participants registered for the latter.
Any participation in the Contest on plain paper or in any other form is excluded.
2.3.
Participation in the Contest will only be valid if the information required by LauguiConcept is complete and correct.
All registrations made using incorrect or falsified information or via counterfeit or falsified forms will automatically forfeit any right to obtain any winning prize.
2.4.
All participants undertake to comply with the Rules. Any non-compliance with the Rules by the Participant, and in particular any fraud, abuse, cheating by him, may result in his exclusion from the Game by decision of LauguiConcept. In addition, in the presence of abuse or cheating by one or more participants, LauguiConcept reserves the right to modify or terminate the Contest Game without notice, in particular when the integrity of the Contest Game is called into question in its object.
Article 3: Determination of winners – distribution of prizes
3.1. Bundles
The winner will be determined by drawing lots between the participants via Facebook. This winner wins the prize indicated in the dedicated publication available on the Platform. Participants may not claim any compensation or consideration whatsoever in the event of cancellation or loss other than any consideration offered by the organizer. The lot offered cannot give rise to any dispute of any kind, nor to the delivery of the counter-value in money, nor to the exchange or replacement for any reason whatsoever by LauguiConcept. If circumstances so require, LauguiConcept reserves the right to replace the prize with other prizes.
3.2. Determination of winners
The winner will be determined by a draw which will be carried out on the date mentioned in the dedicated publication, in the database of people registered for the draws.
3.3. Information of the winners / award ceremony
LauguiConcept will inform the winner by e-mail or private Facebook message on the day of the draw. On this occasion, the winner will be notified of the terms and conditions for taking possession of their prize.
The winner must use his prize from the date indicated. In the absence of a return within the deadlines, the winner will lose his prize without the responsibility of LauguiConcept being engaged, nor any compensation due. If it is a non-electronic prize, it will be delivered within 7 days from the date of designation of the winner, to the winner’s domicile by the company concerned.
Notwithstanding the foregoing, the organizing company also reserves the right to keep the prizes that should have been awarded to the defaulting winner and to dispose of them as it wishes.
Article 4: Modification / termination of the Contest
4.1.
LauguiConcept reserves the right to shorten, extend, modify or cancel the Contest in the event of a case of force majeure which would make it impossible to continue the Contest in accordance with the provisions of the Rules and in particular in the event of malfunction of the Internet network (due to a virus or not), the Platform or any other problem related to networks, means, and (tele)communication services, computers (online or not), servers, providers of access and/or hosting of the Internet, computer equipment or software, data or databases.
4.2.
In the event that such cancellation, modification, extension or reduction of the duration of the Contest should occur, LauguiConcept undertakes to notify the participants by e-mail and/or by publication within the Platform via the dedicated application and, where applicable, to communicate to them the new applicable rules or the new closing date of the Contest.
In the presence of modification of these Rules with regard to the preceding mentions, the continuation of the Contest Game by the registered participants will be worth acceptance of the modifications made, each participant having the possibility of unsubscribing from the Contest Game by contacting LauguiConcept.
4.3.
In the event of modification of the conditions of the Contest Game, cancellation, interruption or reduction of the duration of the Contest Game, the responsibility of LauguiConcept cannot be engaged and the participants cannot claim any compensation, which they accept .
4.4.
Each of the Participants finally accepts that LauguiConcept may terminate the Contest Game, or make changes to it at any time in the event that it observes a significant number of abuses and cheating, whether during registration for the Contest Game or its unfolding itself.
The cancellation or modification of the Contest Game will be communicated to the participants by publication on the Platform or by any means that LauguiConcept deems appropriate.
Article 5: Exemption and limitation of liability
LauguiConcept cannot be held responsible for damages, direct or indirect, whatever the causes, origins, natures or consequences, even if it would have been advised of the possibility of such damages, caused for reason:
(i) malfunction of the Internet network or computer equipment, including the Platform and the application (hardware and/or software and/or databases and/or data) of a Participant or any person or company related to the organization of the Contest or, more generally, any other problem related to networks, means and services of (tele)communications, computers (online or not), servers, access providers and/or hosting the Internet, computer equipment or software, databases and data of anyone;
(ii) the veracity of the information given by the Participant, and which it could not validly consider as not respecting the provisions of these rules and the Conditions of Use with regard to the information and means in its possession;
(iii) any manufacturing defect, breakdown or other malfunction, the compliance of the lots with the standards to which they may be subject or the safety of use of the lots offered (under normal conditions of use) which would not be its own products.
LauguiConcept declines all responsibility for damage caused by events beyond its control, resulting from the use of the lot, or the service of a supplier.
Article 6: Participation fees
The Contest Game is free and without obligation to purchase.
The Rules are made available to participants free of charge on the Platform dedicated to the Game.
Article 7: Dispute
In the event of a dispute or complaint concerning the Contest Game for any reason whatsoever, requests must be sent in writing to the attention of LauguiConcept by post to the address mentioned in the preamble, for the duration of the Contest Game and maximum in a period of sixty (60) days after the designation of the winners.
In the event of a dispute or complaint concerning the prizes awarded, requests must be sent in writing to the attention of LauguiConcept, by e-mail to the address [email protected] or by post to the address mentioned in the preamble in a period of seven (7) days after receipt of the confirmation of the price.
Each participant undertakes in the event of any difficulty that may arise regarding the application or interpretation of the Rules, to make an amicable appeal to LauguiConcept prior to any legal action against the latter.
The Rules are subject to French law. In the event that no amicable solution is found between the participants and LauguiConcept, any dispute arising from these Rules will be submitted to the ordinary courts of France.
Article 8: Personal data
In accordance with the provisions of the law relating to the protection of individuals with regard to the processing of personal data, files and freedoms, as well as all the texts relating to the execution of the provisions provided for therein, the participant is informed that all of the information requested in the Contest Game registration form is mandatory, and mentioned as such, and that failure to answer these questions by the participant will prohibit him from participating in the Game.
The data collected is strictly necessary for the proper execution of the Game. Any use for purposes other than those expressed in these Rules must be expressly authorized by the participant. By participating in the Game, the participant accepts the Rules and the collection of said data. The data will be deleted within 3 months following the end of the Contest, unless otherwise expressly agreed by the participant.
LauguiConcept may publish and reproduce on the Platform the image, the recording of the voice and the name of the winner, provided that the latter consents thereto at the request of LauguiConcept.
Consequently, the data collected is transmitted only to LauguiConcept in its capacity as organizer of the Contest established in France.
Any Participant also has the right to access, rectify, block and delete data concerning him by contacting LauguiConcept directly by e-mail at [email protected] at the address mentioned in the preamble .
It is specified in this respect that any request to delete this data by any means whatsoever during the duration of the Contest Game may result in the cancellation of registration for the Contest Game.
In the event that the participant expressly expresses his desire to receive the LauguiConcept Newsletter, the data transmitted will then be collected for the purposes of surveys, analyzes or within the framework of commercial operations by LauguiConcept.
Article 9: Electronic evidence agreement
LauguiConcept may rely, in particular for the purposes of proof of any act, fact or omission, programs, data, files, recordings, operations and other elements of nature or in computer or electronic format or medium, established, received or stored directly or indirectly by it or the participants, except abuse or manifest error. Participants undertake not to contest the admissibility, validity or probative force of the elements in format or computer or electronic medium mentioned above. Thus, the elements considered constitute evidence and, if they are produced as evidence by LauguiConcept in any contentious or other proceedings, they will be admissible and enforceable between the parties in the same way, under the same conditions and with the same force. probative than any document drawn up, received or kept in writing.
